This website is operated by Green Inbox Inc. under the Outbound Art brand. Throughout the site and these Terms of Service, the terms “Outbound Art,” “we,” “us,” and “our” refer to Green Inbox Inc.

Outbound Art offers this website, including all information, tools, products, and services available through the website, to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our website, using our image preview or personalization tools, uploading an image, and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service, including any additional terms, conditions, and policies referenced herein or available by hyperlink.

These Terms of Service apply to all users of the website, including browsers, customers, purchasers, users who upload images, vendors, merchants, and contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the website, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use the Service.

Our store is hosted on Shopify Inc. Shopify provides us with the online e-commerce platform that allows us to sell our products and Services to you.

SECTION 1 - ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state, province, or other jurisdiction of residence, or that you are the age of majority and have given us permission to allow your minor dependants to use this website under your supervision.

You must not transmit any worms, viruses, malware, or other code of a destructive or harmful nature.

You agree not to reproduce, duplicate, copy, sell, resell, reverse engineer, or exploit any portion of the Service, use of the Service, access to the Service, image-generation system, dice-map system, website content, product design, or contact through which the Service is provided without our express written permission.

The headings used in these Terms are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 3 - ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION

We are not responsible if general information made available on this website is inaccurate, incomplete, or not current. Material on this website is provided for general information and should not be relied upon as the sole basis for making decisions without consulting more complete or timely sources of information where appropriate.

Any reliance on material made available through the website is at your own risk.

This website may contain historical information that is not current and is provided for reference only.

We reserve the right to modify the contents of the website at any time, but we have no obligation to update information except where required by law.

SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES

SECTION 5 - PRODUCTS AND SERVICES

Certain products or Services may be available exclusively online through the website. Products may have limited quantities and are subject to return, replacement, cancellation, or exchange only in accordance with our Refund Policy and applicable law.

We have made reasonable efforts to display our products, dice mosaics, previews, colours, proportions, and images as accurately as possible. However, we cannot guarantee that the display on your computer, telephone, tablet, or other device will accurately represent the finished product.

We reserve the right, but are not obligated, to limit the sale of our products or Services to any person, household, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis where permitted by law.

We may limit the quantities of products or Services offered or purchased.

Product descriptions, availability, dimensions, components, packaging, and pricing may be changed at any time without notice. We reserve the right to discontinue a product at any time.

Any offer made through this website is void where prohibited.

We do not guarantee that a product or Service will meet every personal expectation. This does not affect warranties, remedies, or consumer rights that cannot lawfully be excluded.

SECTION 6 - PERSONALIZED PRODUCTS AND CUSTOMER IMAGES

Our Service allows customers to upload photographs, artwork, designs, and other images for the purpose of creating previews, dice maps, personalized products, and related materials.

By uploading an image, you represent and warrant that:

(a) you own the image or have all necessary rights and permission to use it;

(b) our processing and use of the image to provide the Service will not infringe the copyright, trademark, privacy, publicity, personality, contractual, or other rights of any person;

(c) the image was not obtained or submitted unlawfully; and

(d) the image does not contain unlawful, abusive, exploitative, threatening, defamatory, obscene, or otherwise prohibited content.

You retain ownership of your uploaded image.

You grant Outbound Art a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, crop, resize, modify, process, convert, and reproduce the image only as reasonably necessary to:

(a) provide a digital preview;

(b) generate a dice map or product design;

(c) manufacture and fulfil your personalized order;

(d) provide customer service;

(e) investigate technical or order-related issues; and

(f) comply with applicable legal and regulatory requirements.

We will not use your uploaded image in advertising or public promotional material without separate permission from you.

We reserve the right to reject, remove, or decline to manufacture an image or order that we reasonably believe violates these Terms, infringes the rights of another person, creates legal or safety concerns, or is otherwise inappropriate for the Service.

The completed dice mosaic is a stylized interpretation of the submitted image. Differences may result from the limited number of dice positions, pip configurations, contrast levels, cropping, image quality, lighting, resolution, product size, screen display, and assembly.

The digital preview is an approximation of the expected design and is not a guarantee that every detail will appear in the finished product.

You are responsible for reviewing the selected image, crop, orientation, size, and available preview before placing your order. Once processing or production begins, changes and cancellations may not be possible.

Personalized products may be subject to different return or cancellation conditions than non-personalized products, as explained in our Refund Policy. Nothing in this section limits rights that cannot lawfully be excluded.

Our collection, processing, retention, and deletion of uploaded images and personal information are also governed by our Privacy Policy.

SECTION 7 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse or cancel an order where permitted by law.

We may limit or cancel quantities purchased per person, household, customer account, payment method, billing address, shipping address, or order. These restrictions may apply to orders that appear to have been placed by dealers, resellers, distributors, automated purchasing systems, or persons attempting to misuse a promotion.

If we change or cancel an order, we may attempt to notify you using the email address, billing address, shipping address, or telephone number provided when the order was placed.

You agree to provide current, complete, and accurate purchase, delivery, and account information for all purchases.

You agree to promptly update your information, including your email address, payment details, shipping address, and telephone number, so that we can complete your transactions and contact you when needed.

SECTION 8 - OPTIONAL TOOLS

We may provide access to third-party tools over which we have limited or no control.

You acknowledge that access to such tools may be provided “as is” and “as available,” without warranties, representations, or endorsements except as expressly stated by us or required by law.

Your use of optional third-party tools is at your own risk and discretion. You should review and understand the terms and privacy practices of the relevant third-party provider.

We may offer new Services, tools, and website features in the future. These new Services and features will also be subject to these Terms of Service.

Certain content, products, tools, payment services, shipping services, or other features available through our Service may include materials or services provided by third parties.

Third-party links may direct you to websites that are not affiliated with us.

We are not responsible for examining or evaluating the content, accuracy, availability, security, or practices of third-party websites or services.

To the fullest extent permitted by law, we are not responsible for harm or damage connected with your voluntary use of third-party websites, services, resources, or transactions.

Please review the policies and practices of each third party before engaging in a transaction with them. Questions or complaints concerning a third-party product or service should be directed to the applicable third party.

SECTION 10 - USER COMMENTS, FEEDBACK, AND OTHER SUBMISSIONS

If you send us contest entries, reviews, comments, ideas, suggestions, proposals, plans, or other non-personalized-product submissions, collectively referred to as “Comments,” you agree that we may use those Comments without restriction, unless we have agreed otherwise in writing.

This section does not give us permission to use your private customer photograph in advertising. Customer images uploaded for personalized products are governed by Section 6.

We are under no obligation to:

(a) maintain Comments in confidence;

(b) pay compensation for Comments; or

(c) respond to Comments.

We may monitor, edit, or remove content that we determine, in our reasonable discretion, is unlawful, offensive, threatening, defamatory, obscene, infringing, misleading, or otherwise violates these Terms.

You agree that your Comments will not violate the rights of any third party, including copyright, trademark, privacy, publicity, personality, or other personal or proprietary rights.

Your Comments must not contain unlawful, abusive, obscene, misleading, malicious, or harmful material, or malware that could affect the operation of the Service.

You may not use a false email address, impersonate another person, or mislead us or third parties concerning the origin of any Comment.

You are responsible for the Comments you submit and their accuracy.

SECTION 11 - PERSONAL INFORMATION

Your submission of personal information through the website is governed by our Privacy Policy.

Uploaded photographs and other customer images may contain personal information. Please do not upload an image unless you have the authority and permission necessary to provide it to us for the purposes described in these Terms and our Privacy Policy.

SECTION 12 - ERRORS, INACCURACIES, AND OMISSIONS

Occasionally, information on our website or in the Service may contain typographical errors, inaccuracies, or omissions relating to product descriptions, previews, pricing, promotions, offers, shipping charges, transit times, product availability, or other matters.

We reserve the right to correct errors, inaccuracies, or omissions and to change or update information where permitted by law.

We may cancel an order if material information concerning the order was inaccurate, including after the order was submitted, subject to applicable law and any refund obligations.

We undertake no obligation to update, amend, or clarify information except where required by law.

A displayed update or refresh date should not be taken to indicate that all information on the website has been modified or updated.

SECTION 13 - PROHIBITED USES

In addition to other prohibitions stated in these Terms, you are prohibited from using the website, Services, tools, previews, or content:

(a) for any unlawful purpose;

(b) to encourage or participate in unlawful acts;

(c) to violate any applicable international, federal, provincial, state, or local law or regulation;

(d) to infringe our intellectual property rights or the intellectual property rights of others;

(e) to upload an image that you do not have the right or permission to use;

(f) to harass, abuse, threaten, insult, harm, defame, intimidate, or unlawfully discriminate against another person;

(g) to submit false, fraudulent, or misleading information;

(h) to upload or transmit viruses, malware, or other harmful code;

(i) to collect or track the personal information of others without lawful authority;

(j) to spam, phish, pharm, pretext, spider, crawl, scrape, or use automated systems to access the Service without authorization;

(k) for an obscene, exploitative, or unlawful purpose;

(l) to interfere with or circumvent the security or operation of the Service;

(m) to copy, reverse engineer, or misuse the image-processing, dice-map, preview, or personalization systems; or

(n) to place fraudulent orders or misuse payment, promotional, return, or refund systems.

We reserve the right to terminate or restrict your use of the Service for violating these prohibited uses.

SECTION 14 - DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

We do not guarantee that your use of the Service will always be uninterrupted, timely, secure, or error-free.

We do not guarantee that every result generated by the website, including an image preview, dice map, crop, layout, or visual representation, will be perfectly accurate or identical to the completed physical product.

From time to time, we may suspend or remove the Service for maintenance, technical, security, commercial, or other reasons.

To the fullest extent permitted by law, your use of the Service is at your own risk. Except as expressly stated by us or required by law, the Service and products delivered through the Service are provided “as is” and “as available,” without additional representations, warranties, or conditions, express or implied.

To the fullest extent permitted by law, Outbound Art and its directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, licensors, successors, and assigns shall not be liable for indirect, incidental, punitive, special, exemplary, or consequential damages, including lost profits, lost revenue, lost savings, lost data, or replacement costs, arising from:

(a) your use of or inability to use the Service;

(b) your use of a product purchased through the Service;

(c) errors or omissions in website content;

(d) unauthorized or improper use of an uploaded image;

(e) failure to follow assembly, safety, mounting, care, or installation instructions; or

(f) content, products, or services made available through the Service.

Where a jurisdiction does not allow certain exclusions or limitations of liability, our liability shall be limited only to the maximum extent permitted by law.

Nothing in these Terms excludes, restricts, or limits a statutory warranty, consumer right, remedy, or liability that cannot lawfully be excluded, restricted, or limited.

SECTION 15 - INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Green Inbox Inc., carrying on business as Outbound Art, and its affiliates, partners, officers, directors, employees, agents, contractors, licensors, suppliers, service providers, subcontractors, successors, and assigns from claims, demands, losses, liabilities, or reasonable legal expenses arising from:

(a) your material breach of these Terms;

(b) your unlawful use of the Service;

(c) an image or other content uploaded by you that infringes the rights of another person;

(d) your violation of an applicable law; or

(e) your violation of the rights of a third party.

This section does not require you to indemnify us for liability caused solely by our own unlawful conduct where such indemnification is prohibited by law.

SECTION 16 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall remain enforceable to the fullest extent permitted by law.

The unenforceable portion shall be deemed severed from these Terms, and the determination shall not affect the validity and enforceability of the remaining provisions.

SECTION 17 - TERMINATION

The obligations and liabilities of the parties incurred before termination shall survive termination where their nature requires them to survive.

These Terms remain effective unless and until terminated by you or us.

You may terminate your agreement to these Terms by notifying us that you no longer wish to use the Service and by ceasing to use the website.

If, in our reasonable judgment, you fail or we reasonably suspect that you have failed to comply with these Terms, we may suspend or terminate your access to the Service without notice where permitted by law.

You will remain responsible for amounts properly due up to and including the date of termination.

SECTION 18 - PRODUCT SAFETY AND AGE RESTRICTIONS

This product is intended for persons aged 12 and older.

It is not intended for children under 12. Persons under the age of majority should assemble and handle the product only under direct adult supervision. Wall installation must be completed or directly supervised by an adult.

WARNING: CHOKING HAZARD - Small parts. Not for children under 3 years.

The product contains numerous small dice and other small components that may present choking, ingestion, or inhalation hazards.

Keep all loose dice, backing liners, packaging materials, discarded materials, and other small components away from children under 3, young children who may place objects in their mouths, and pets.

The dice and other components must not be placed in the mouth, licked, chewed, swallowed, inhaled, thrown, or used for a purpose other than their intended use.

The product is a decorative craft and display product. It is not intended to be used as a children’s toy.

SECTION 19 - ADHESIVE MATERIALS

The product contains two separate adhesive systems:

(a) adhesive-coated cardboard panels onto which the dice are placed during assembly; and

(b) separate double-sided mounting tape used to attach the completed product sections to a wall.

The adhesive surfaces, mounting tape, adhesive backing, release liners, and other product components are not intended for oral contact or consumption.

Do not lick, chew, swallow, or place any adhesive material in the mouth.

Avoid contact between adhesive materials and the eyes. Wash your hands after handling exposed adhesive materials and before eating or touching your eyes or mouth.

Keep unused tape, backing liners, release liners, discarded adhesive materials, and other components away from young children and pets.

If skin irritation occurs, stop handling the adhesive and wash the affected area.

If adhesive material is swallowed, enters the eyes, or causes an adverse reaction, seek appropriate medical advice.

SECTION 20 - ASSEMBLY, WALL INSTALLATION, AND DISPLAY

Depending on the selected product size, the completed artwork consists of 9 or 25 individual sections. Each section is separately attached to the wall using the supplied double-sided mounting tape.

Follow all assembly, safety, installation, mounting, and care instructions supplied with the product.

Before mounting the product, ensure that the wall surface is clean, dry, smooth, stable, undamaged, and suitable for adhesive installation.

The mounting tape may not be suitable for every wall, paint, wallpaper, wall covering, coating, finish, texture, or environmental condition.

Dust, grease, moisture, humidity, heat, cold, wall texture, deteriorating paint, recently applied paint, incorrect surface preparation, insufficient pressure, or improper installation may reduce the strength of the adhesive bond.

Where appropriate, test the mounting tape on a small and inconspicuous area before installing the complete product.

Use the supplied mounting tape only in the locations, quantities, and manner specified in the installation instructions.

Installation, repositioning, or removal may damage paint, wallpaper, drywall, wall coverings, finishes, or other surfaces.

The adhesive-coated cardboard or mounting tape may weaken or lose adhesion over time. An individual die may loosen from the cardboard panel, or an entire section may loosen or detach from the wall.

Dice or sections may also become loose during assembly, transportation, handling, installation, repositioning, removal, or display.

Placing the product high on a wall or otherwise outside a child’s reach does not eliminate the possibility that an individual die or section may fall and become accessible.

Do not install or display the product above or immediately beside:

(a) a crib;

(b) a child’s bed;

(c) a play area;

(d) a seating or sleeping area;

(e) a frequently used walkway;

(f) fragile or valuable property; or

(g) another location where a falling die or section could cause injury or property damage.

Press each die and each wall-mounted section firmly into place in accordance with the instructions.

Inspect the completed product periodically for loose dice, lifting cardboard, weakened adhesive, damaged sections, or insecure wall mounting.

If any die, cardboard panel, section, or mounting point becomes loose or damaged, remove or secure the affected section immediately and keep all loose parts away from children and pets.

In a home or other location accessible to young children or pets, we strongly recommend displaying the completed artwork inside a securely mounted, fully enclosed frame or protective display with a transparent front panel and secure backing.

To the fullest extent permitted by law, Outbound Art is not responsible for injury, choking, ingestion, inhalation, property damage, wall damage, surface damage, or other loss resulting from:

(a) improper assembly, installation, mounting, handling, display, repositioning, or removal;

(b) failure to follow the supplied instructions or warnings;

(c) use on an unsuitable, damaged, dirty, damp, textured, unstable, or deteriorating surface;

(d) failure to inspect or maintain the product;

(e) failure to keep loose components away from young children or pets;

(f) use by a person below the recommended age;

(g) misuse or unintended use of the product; or

(h) ordinary weakening, deterioration, or failure of an adhesive connection over time.

Nothing in this section excludes or limits a right, remedy, statutory warranty, or liability that cannot lawfully be excluded or limited.

SECTION 21 - ENTIRE AGREEMENT

Our failure to exercise or enforce a right or provision of these Terms shall not constitute a waiver of that right or provision.

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, product instructions, safety warnings, and any other policies or operating rules posted on the website, constitute the entire agreement between you and us concerning your use of the Service.

These Terms supersede prior or contemporaneous agreements, communications, and proposals concerning the Service, whether oral or written, including prior versions of these Terms.

Any ambiguity in the interpretation of these Terms shall not automatically be interpreted against the party that drafted them.

SECTION 22 - GOVERNING LAW

These Terms of Service and any separate agreement through which we provide products or Services shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.

Nothing in this section deprives a consumer of the protection of mandatory laws that apply in the consumer’s place of residence and cannot lawfully be waived.

We reserve the right to update, change, or replace any part of these Terms by posting updates and changes on the website.

Where required by law, we will provide additional notice of material changes.
